“JACK’S 3RD SHOW/ NISSAN ROGUE” Contest

OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.  VOID WHERE PROHIBITED.

1. How to Enter the Contest

1. 93.1 JACK FM/ KCBS “JACK’S 3RD SHOW/ NISSAN ROGUE” (“Contest”) will begin on 9/2/08 at approximately 9 AM Pacific Time (“PT”) and will end on 9/27/08 at approximately 4PM PT.
   
2. To participate in the Contest, you may enter via the following methods:

1. Enter onsite at any of the eight (8) Jack’s 3rd Show/ Nissan Rogue events (see attached page for dates, times, and locations).  Fill out an entry form with your full name, complete address, daytime telephone number and date of birth and deposit the completed entry form onsite during the prescribed time period.  All entries must be received by the designated deadline at each event.  In addition, at the conclusion of six of the eight events, KCBS will randomly draw 1 entry from each event (total of 6).  The selected entrants will win a qualifying prize of a pair of tickets to Jack’s 3rd show.
2. Listen to 93.1 Jack FM between 9/2/08 and 9/26/08, including weekends, for the cue to call.  The cue to call will be announced at approximately 9:00am, 12:00 pm, 3:00 pm & 6:00 pm PT.  After the cue to call is announced, the twentieth (20th) caller to get through to the station’s contest line at 866.931.5225 (866.931.JACK) will win a qualifying prize and will qualify to win the grand prize, subject to confirmation of eligibility.
3. Attend 93.1 Jack FM’s “Jack’s 3rd Show” on 9/27/08 at the Verizon Wireless Amphitheater located at 8800 Irvine Center Dr Irvine, CA  92618 and fill out an entry form on site between 2 PM and 4 PM with your full name, complete address, daytime telephone number and date of birth and deposit the completed entry form in the entry box.  One entry box will be located outside the venue at the front of the box office and one entry box will be located inside the venue at the Nissan showcase area.  All entries must be received by 4 PM on 9/27/08. 

1. KCBS-FM is not responsible for lost, late, stolen, incomplete, illegible or untimely entries. 

1. KCBS-FM is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call.  Listeners may call as often as they like to attempt to win a prize, but a listener may be a qualifying prize winner only once during the contest period.

1. Eligibility Restrictions

1. The contest is open to all persons who are 18 years of age or older and who reside in the greater Los Angeles area. Employees of KCBS-FM (the “Station”), its licensee, corporate parents, subsidiaries, and affiliates, their advertising agencies, participating sponsors/promotional partners, other radio stations in the Los Angeles metropolitan area and the members of their immediate families and or households are ineligible to participate or win. 

1. Only one winner per household is permitted in any Contest administered by the Station. If you or any member of your family/household won any prize from JACK FM with in the past 30 days, you will be disqualified from this contest.

1. Winners will be required to sign a liability and publicity release and show a valid government- issued photo identification card to claim prize.   

1. Grand prize winner must possess a valid driver’s license at the time of winning and must meet any restrictions required by Cerritos Nissan.  Winner must also provide proof of valid car insurance under their name at the time of winning. 

1. Prizes:

a.   A total of one-hundred (100) qualifying prizes will be awarded.  The qualifying prize is two (2) tickets to 93.1 Jack FM’s “Jack’s 3rd Show” scheduled for 9/27/08 from 2pm to 11pm at the Verizon Wireless Amphitheater.  Tickets must be claimed at the station or the will call booth at Verizon Wireless by 9/27/08 8 PM.  Tickets not claimed by this time will be forfeited.

1. One grand prize will be awarded.  The grand prize is a 2009 Nissan Rogue Approximate retail value: $29,909. 

1. Grand prize winner will be solely responsible for any applicable vehicle title, license and registration fees, freight, delivery, dealer prep, emissions inspection, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance, all other fees and expenses not specified herein associated with the receipt and use of this prize vehicle.  Any additional car options (including the interior and exterior color of the prize) not specified herein is subject to availability and will be the responsibility of the winner.  Winner must provide proof of insurance and a valid driver’s license.  Winner will accept the chosen prize vehicle "as is."  Neither the Station nor sponsor accepts responsibility for repairing any real or supposed damage to the prize vehicle from this contest.  If the prize is not available at sweepstakes end including vehicle color, a substitution of equal or greater value will be made at the Station’s or participating sponsor’s choice. Neither the Station nor the other sponsors have made or are responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the prize vehicle, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the vehicle.  Winner must take delivery of vehicle at Cerritos Nissan, 18707 Studebaker Rd, Cerritos, CA  90703, within forty-five (45) of notification or prize will be forfeited in its entirety.

1. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash.  The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses.  Other restrictions may apply.

4. Selection of Winners

1. Decisions of Station management with respect to the Contest are final.
   
2. A total of 3 qualifying prize winners will be selected as described in Section 1.b.2. of these rules. 

1. One grand prize winner will be selected on 9/27/08 at approximately 7 PM on location at “Jack’s 3rd Show”.  Winner selection will be as follows: one (1) grand prize finalist will be selected at approximately 6 PM on 9/27/08 in a random drawing of eligible entries received at the Nissan Rogue events as described in Section 1.b.1. of these rules.  One (1) grand prize finalist will be selected at approximately 6 PM on 9/27/08 in a random drawing of all on-air qualifying prize winners.  One (1) grand prize finalist will be selected at approximately 6 PM on 9/27/08 in a random drawing of eligible entries received at Jack’s 3rd Show as described in Section 1.b.1. of these rules.  The grand prize winner will then be selected in a random drawing from among the three grand finalists.   

1. Qualifying prize winners will be notified of their prize upon being the correct designated numbered caller.  Grand prize winner will be notified on location (announced on stage) and by telephone on 9/27/08.  If grand prize winner cannot be contacted within 14 days of notification then grand prize winner forfeits prize An alternate winner be selected?  Randomly from the rest of the entries collected.    

1. Qualifying prize winners must listen to win.  Grand prize winner need not listen or be present to win.

1. Qualifying prize winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form by 10/10/08 at 5 PM or prize will be forfeited and an alternate winner will not be chosen.

1. Grand prize winner must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within forty-five (45) of notification or prize will be forfeited in its entirety and another winner will not be chosen.

1. Conditions

1. Payments of all federal, state and local taxes are solely the responsibility of the winners.  Winners will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.

1. By participating in the Contest, winners and their guests agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. 

1. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require Contest winners and their guests to sign a liability release, agreeing to hold the Station, its corporate licensee, and each of their parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.

1. The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize, equivalent value or location of prize giveaway, which will become effective upon announcement.  If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.

1. Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of the Station.

1. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.

1. Copies of the written Contest rules and a list of winners (when complete) are available during regular business hours at the main studio of KCBS – 5901 Venice Blvd, LA, CA  90034.
